General Terms and Conditions

PREAMBLE

The site https ://www.uski.swiss is an  e-commerce "Site" offering for sale items to  " Buyers".

The Buyer is any person who visits the Site, whether he has initiated a purchase process on this Site.
The  "Seller" is the company uSki Sàrl, whose registered office is located at 4 chemin de la Perrousaz, registered in the Swiss Commercial Register with the following identification and VAT number: CHE-166.690.068 

These General Terms and Conditions (GTC) govern and apply without restriction or reservation to all relations between uSki Sàrl and any person who purchases products on this Site.

ARTICLE 1: PURPOSE AND SCOPE

The GTC aim to define the terms of sale between the Seller and the Buyer. They apply to all sales of products offered on the Site, whether the order was placed by telephone, email, or Internet.
Any order on the Site necessarily implies the knowledge by the Buyer, of these GTC, prior to the order, and the acceptance of all their content by the Buyer. The acceptance of these GTC takes effect upon validation of your order.
The applicable GTC are those in force on the day of validation of the order by the Buyer. uSki Sàrl reserves the right to modify at any time and without notice the GTC, the modifications being then applicable to all orders after this modification.

ARTICLE 2: THE USKI OFFER

2-1 Geographical coverage of the offer

The products sold online presented on the Site are delivered to most countries. The geographical area of coverage of each sale may vary according to the distribution agreements of each of the referenced suppliers as well as the delivery methods. 

2-2 Stock and availability

A product mentioned "in stock" is present in the own stocks of uSki Sàrl. The actual availability of a product may vary rapidly depending on the sales made on the Site. A product marked "available within x days" means that we will be supplied within this period in working days by our supplier, subject to availability from our suppliers. Indeed, errors or modifications may exceptionally occur. A product marked "available at XX/XX/XX", means that we will receive the product on that date in our warehouses. This date does not correspond to the date of receipt of the product at the Buyer's home. uSki Sàrl cannot be held responsible if the indicative time of availability of the product(s), and their delivery is modified. In the event of unavailability of product after placing the order, uSki Sàrl undertakes to contact the Buyer as soon as possible, by phone or email. The Buyer may choose to maintain his order or cancel it.  uSki Sàrl will make the refund by crediting the Buyer no later than fourteen (14) days of payment.

2-3 Product characteristics

The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, uSki Sàrl could not be held liable.

2-4 Prices

The prices of our products are indicated in Swiss Francs all taxes included and are firm and final.
They do not include shipping costs and other processing costs related to the Buyer's order invoiced in addition and indicated before the validation of the Buyer's order.
uSki Sàrl reserves the right to modify its prices at any time without notice. The products will be invoiced to the Buyer based on the rates recorded at the time of validation of the order.
Products remain the property of uSki Sàrl until they are paid in full.

2-5 Export orders and customs duties

Any order shipped outside Switzerland will be automatically invoiced excluding tax.
Import formalities, customs duties and any taxes related to the delivery of an item outside Switzerland are the exclusive responsibility of the Buyer. They must be paid to the competent authorities of the country of delivery. The Buyer is solely responsible for verifying the possibilities of importing the products ordered under the law of the country of delivery. uSki Sàrl is not obliged to verify and inform the Buyer of applicable customs duties and taxes. Please note that by ordering on the Site, you are considered the importer of record and are required to comply with all laws and regulations of the country where you will receive the goods. Cross-border deliveries may be subject to an opening and inspection procedure by the customs authorities.

ARTICLE 3: PROCEDURE AND MODALITY OF ORDER

3-1 Condition for placing an order

The Buyer must have the legal capacity or hold parental authorization allowing him to place an order on the site.

3-2 Order process

1.    Choosing items and adding to cart
2.    Validation of the contents of the basket
3.    Identification on the Site if the customer is not already identified
4.    Choice of delivery method
5.    Choice of payment method and acceptance of the GTC
6.    Validation of payment.
7.    Shipment of goods.

The Buyer can place his order on the Internet via the site. The data communicated by the buyer and recorded by uSki Sàrl when ordering constitute proof of transactions between uSki Sàrl and the Buyer. The validation after completing the order form constitutes the confirmation of the order of the buyer and constitutes an electronic signature of the same value as a handwritten signature. It will be worth irrevocable acceptance of the General Terms and Conditions.
The conclusion of the contract will only be effective after sending an email confirming the registration of the order by uSki Sàrl.
After registration of the order, a detailed invoice printable by the Buyer will be sent by email to the Buyer.
uSki Sàrl reserves the right to refuse a delivery or to honor an order in cases where the Buyer has not paid in whole or in part for a previous order, or if a payment dispute remains.

3-3 Order processing

Any order placed before noon from Monday to Friday (excluding public holidays) is prepared and shipped no later than the next day if all products are indicated in stock and subject to validation of payment. Delivery times are understood from the collection of packages from our warehouse. 

ARTICLE 4: PAYMENT

uSki Sàrl offers different types of payment. Orders are payable in CHF. Payment of the full price is due at the time of the order by the Buyer who undertakes to pay the price stipulated for the item(s) ordered including the price of the items, as well as shipping costs and other processing costs of the order. 

4 -1 Payment by credit card

Only payment by one of the following credit cards will be accepted: CB, Visa, Mastercard, Maestro. The card is debited at the time of confirmation of the order. The Buyer guarantees to the company uSki Sàrl that he has the necessary authorisations to use the method of payment by card when taking the order. uSki Sàrl implements all necessary means to ensure the security and confidentiality of the data transmitted on the Site at the time of payment by credit card.

4-5 Non-payment and retention of title

The products ordered remain the property of uSki Sàrl until final and full payment of their price, including shipping costs and taxes.  In case of non-payment, the Buyer is required to return the goods concerned to uSki Sàrl,  return costs at his expense, under penalty of legal proceedings.  All attempted fraudulent use of a means of payment will also be subject to legal proceedings.

ARTICLE 5: DELIVERY

The products are delivered to the delivery address mentioned during the ordering process. In case of error in the wording of the contact details, uSki Sàrl cannot be held responsible for the impossibility of delivery. In this case the costs incurred for a new delivery will be borne by the Buyer and invoiced at their actual cost. uSki Sàrl undertakes to deliver the ordered items as soon as possible depending on the delivery method chosen and the availability of the items. The delivery times indicated on the Site are usual average times and correspond to the total processing and delivery time. Delivery is deemed to have been made upon delivery of the product to the Buyer. The delivery note issued by the carrier will constitute proof of carriage and delivery.

5 -1 Checking the condition of the package upon delivery

uSki Sàrl recommends that the Buyer check the contents, conformity, and condition of the package(s) upon delivery and in the presence of the carrier.
If the Buyer has any doubt of any kind whatsoever about the condition or content of his package, the Buyer must exercise any recourse with the carrier by registered letter with acknowledgment of receipt within three (3) working days of receipt and send a copy to uSki Sàrl.
After this period, the product will be deemed to  be received in conformity by the customer, who will no longer be able to claim a delivery error or an apparent defect.
The verification of the delivered package is deemed to have been made and can no longer be contested as soon as the Buyer or any person authorized to receive the package has signed the delivery note. The responsibility of uSki Sàrl can in no way be questioned.

5-2 Delay in delivery

If a delay in delivery occurs, or packages are lost by the carriers, the Buyer must notify uSki Sàrl by email or telephone  within ten (10) days of receipt by email of the order confirmation. We will accompany you in the steps with the carriers.

5-3 Delivery in case of absence

In case of absence of the recipient at the time of delivery, the carrier will leave a notice of passage at the delivery address indicated by the Buyer. The order must be collected at the address and according to the modalities indicated by the carrier.
In case of non-withdrawal within the time limits set by the carrier, the order will be returned to uSki Sàrl, which reserves the right to refund the price, the shipping costs remaining the responsibility of the Buyer.

ARTICLE 7: AFTER-SALES SERVICE / LEGAL GUARANTEES

7-1 Contractual guarantee

The Buyer benefits free of charge from the guarantee given by uSki Sàrl. The Seller cannot be held responsible for the misuse and / or intensive use of the items that the customer may make. Please find below the procedure for a possible assumption under the contractual guarantee by our after-sales service:

1.    We ask you to send a photo even if the defect is not apparent and a precise description of the problem by email to info@uski.swiss.
2.    uSki Sàrl informs you of its decision to take as a guarantee.
3.    We ask you to send us  the product with the purchase invoice. The return costs are at your expense.

For information, the duration of treatment of a service can be up to 2 weeks.

7-3 Exclusion

Contractual guarantees do not cover:

– abnormal or improper use of the products. In this regard, we invite you to carefully consult the instructions for use supplied with the product.
– defects and their consequences related to use not in accordance with the use for which the product is intended
– defects and their consequences related to any external cause.

ARTICLE 8: RETENTION OF TITLE

Any order remains the property of uSki Sàrl until the final and full payment of the latter by the Buyer.
The transfer of responsibility to the Buyer is effective as soon as the package is handed over by uSki Sàrl to the carrier.

ARTICLE 9: DATA PROTECTION

The information requested by uSki Sàrl is essential for the management of the Buyer's order (processing and delivery of orders, establishment of invoices). 
All personal data will be considered confidential. They remain private and will not be shared or used by third parties.
Their lack of information may degrade or prevent the provision of the service or product requested by the Buyer. 
Depending on the selection made by the Buyer when creating or modifying his account, he may receive information and commercial offers from uSki Sàrl. The Buyer may at any time decide to unsubscribe from the delivery of these messages. 

ARTICLE 10: INTELLECTUAL PROPERTY

All elements of this site are and remain the exclusive intellectual property of uSki Sàrl. Only use for private use is allowed. Any partial or total reproduction of all or part of the elements appearing on this site is prohibited unless it has been approved by uSki Sàrl.

ARTICLE 11: LIABILITY

uSki Sàrl cannot be held responsible for the non-performance or poor performance of the contract concluded between the parties in the event of force majeure, the occurrence of an event attributable to the Buyer or any inconvenience, foreseeable and insurmountable damage inherent in the use of the Internet.  uSki Sàrl cannot be held liable for any indirect damage that may occur as a result of the purchase of products.
The photographs, graphics and descriptions accompanying the products have no contractual value and can therefore not engage the responsibility of uSki Sàrl. As the Site is hosted  by an external service provider, uSki Sàrl cannot be held responsible for an interruption of service of the Site, occurrence of bugs, inaccuracies or omissions relating to information available on the Site or for any damage resulting from fraudulent intrusion by a third party having altered the information on the Site. For all stages of access to the Site, consultation, filling in forms, placing an order, delivery of items or any other service, uSki Sàrl has only an obligation of means.
Consequently, uSki Sàrl cannot be held liable for any inconvenience or damage inherent in the use of the Internet network (loss of data, of files…) and totally external to the diligence and precautions taken by uSki Sàrl.

ARTICLE 13: APPLICABLE LAW 

Applicable law and place of jurisdiction
These GTC shall be executed and construed in accordance with Swiss law, and any dispute shall be dealt with by the Court of Geneva.  In the event of a dispute, the parties will seek an amicable agreement as a priority to any legal action.
